GENERAL CONDITIONS OF USE The Compagnie Nationale du Rhône (hereinafter referred to as CNR), a joint stock company acting in the general interest with a paid up capital of ?5,488,164, enrolled on the Trade Registry of Lyon under number 957 520 901 and whose head office is at 2 rue André Bonin, 69316 LYON cedex 04, offers practical information on the navigation and hydrology of the Rhône, as well as technical information on its infrastructures on the Internet Site inforhône.fr, hereinafter referred to as "the Site". Access to the Site and its use imply tacit and unreserved acceptance of these Conditions by the User, according to their most recent on-line version. 1. DESCRIPTION OF THE SERVICE1. DESCRIPTION OF THE SERVICE CNR offers thematically organised information on the site concerning the Rhône and its infrastructures, as well as the hydrological and navigation conditions encountered on it. The Site's users can also access information on CNR and its activities via a link to CNR's corporate site at cnr.tm.fr. 2. ACCESS AND AVAILABILITY Access to the Site is free and open to all. Access to the Site is assured continually and permanently, except in the case of Acts of God or events outside CNR's control, or in the case of possible failures and maintenance operations required to ensure the efficient operation of the Site. Furthermore, due to the intrinsic nature of the Internet, CNR cannot guarantee round the clock operation of the Site seven days a week. 3. RESPONSABILITY 3.1 CNR attempts to provide users with the most reliable information possible. However, CNR does not guarantee the accuracy and exhaustiveness of the information diffused on the Site. Therefore CNR cannot be held responsible for direct or indirect damage suffered by users or third parties that trace its source to the information diffused on the Site, and more generally to the consultation and use of the Site. 3.2 CNR offers thematically organised information on the site concerning the Rhône and its infrastructures, as well as the hydrological and navigation conditions encountered on it. This information is supplied by CNR free of charge and for the purpose of giving indications. Therefore CNR cannot guarantee the accuracy and exhaustiveness of the information supplied. Thus under these conditions CNR cannot be held responsible for direct or indirect damage suffered by users or third parties that trace its source to the information diffused on the Site, particularly following misinterpretation of the information displayed on the site. 3.3 Furthermore, CNR does not monitor the sites linked to the Site via hypertext links, and refuses any responsibility relating to these sites and the content found in them. 4. INTELLECTUAL PROPERTY 4.1 All the data, whatever their nature and especially texts, graphics, logos, icons, images, audio and video clips, trademarks, and software featuring on the Site are necessarily protected by copyright, trademark registration and all other types of intellectual property rights, and are the property of CNR or third parties that have authorised CNR to use them. As editor of the Site, CNR grants the user permission to use the Site and its contents for their private, non-collective and non-exclusive use. Under these conditions, the user undertakes not to copy, summarise, modify, tamper or rediffuse, without prior written authorisation from the Editor, any text, title, image, software, logo, trademark, information or illustration, for use other than strictly private, said undertaking excluding any representation for professional purposes or rediffusion in number. Likewise, the user undertakes not to copy all or part of the site onto another site or a corporate intranet. Violation of this undertaking may constitute an act of forgery liable to involve the penal responsibility of any person not complying with this clause. 4.2 All the accessible data and contents published on the Site, as well as the procedures for consulting them, make up the Database of CNR's Internet Site. This Database is protected by the stipulations of the Intellectual Property Code regarding copyright, and by the stipulations of the European Directive of 11 March 1996. Under these conditions, the user undertakes to use these data only within the framework of consulting the Internet Site, and shall abstain in particular from reproducing, translating, adapting, arranging, transforming, communicating, representing and distributing, either permanently or temporarily, by any means in any form whatsoever, all or part of the data contained in the databases. 4.3 The creation of hypertext links from another Internet site with CNR's Site shall require the prior written permission of CNR. 5. MISCELLANEOUS 5.1 If one of the clauses of these Conditions should be considered null and void due to an existing or future legal or regulatory ruling, or by a judicial decision having authority over the subject judged and issued by a competent jurisdiction or organisation, said clause of this contract shall be considered as not having been written, although all the other clauses of these General Conditions of Use shall remain binding between the Parties. 5.2 CNR reserves the right to modify these Conditions unilaterally and at any moment it deems fit. The new clauses shall henceforth govern all the relations between the parties, and only the new version shall be considered as binding between them. 5.3 These General Conditions of Use are subject to French law in both form and substance. In the case of dispute, the parties agree to seek an amicable solution before calling on a competent jurisdiction. |
